Client seeks assistance with a landlord/tenant appeal. Landlord’s complaint sought rent for July to September 2017, late fees, attorney’s fees, and court costs. Client and her adult daughter are seeking representation in the Court of Common Pleas to appeal the decision they received in Municipal Court, which awarded attorney’s fees and possession to landlord even though the judge found that the open L&I violations did preclude landlord from collecting rent. Client’s defenses may include breach of implied warranty of habitability and failure to provide tenant with a Certificate of Rental Suitability and with a “City of Philadelphia Partners for Good Housing” Handbook. Client filed a pro se appeal and needs assistance for the pendency of the appeal in the Court of Common Pleas. Opposing counsel is Ken Baritz, Esq. The answer to the complaint is due on November 30, 2017. A settlement conference is scheduled for December 14, 2017, at 1:00 pm, and trial is scheduled for January 8, 2017, at 9:00 am.
