Client seeks assistance with a custody matter concerning her 13-year-old daughter. Client/mother has had primary custody since 2004, pursuant to a custody order entered December 2004. In the summer of 2016, Client made a private agreement with OP/father allowing the child to live with OP for the 2016/2017 school year so that OP and child could spend more time together. In June 2017, child returned to client’s home, and client enrolled her in school there. The child expressed that she wanted to live with client; client also believes it is in the child’s best interest because while in OP’s custody, the child’s school performance deteriorated and child was expected to babysit several small children, and had limited parental supervision. OP, who is represented by an attorney, filed an emergency custody petition in October 2017, which was found to be without cause. The presiding judge advised OP to raise his concerns at the next hearing, which is on client and OP’s cross Petitions to Modify scheduled before Master Godwin-Pierce on December 7, 2017, at 9:45 am. The child has been asked to testify at the next hearing. A volunteer is needed to represent client at the master’s hearing and any subsequent judicial hearings.
