Client seeks assistance with a landlord/tenant matter. The eviction complaint seeks rent from October and November 2017, plus court costs. Client is a 76-year-old Spanish-speaker. She lives in the home with her son who is her caregiver. Client’s daughter co-singed the lease and is also a defendant in the case but does not live in the home. In September 2017, landlord sent a notice to terminate the lease at the end of October. Landlord then refused to take rent from client. Defenses may include failure to have a valid rental license for the entire period in question, excess security deposit, breach of implied warranty of habitability, and failure to provide tenant with a Certificate of Rental Suitability and “City of Philadelphia Partners for Good Housing” Handbook. Client has proof that she has been escrowing the money. Client’s goal is to avoid having a money judgment against her and to have additional time to move. Client’s children are supportive and can help translate; however, interpretation services can also be provided upon request. The hearing is on January 2, 2018, at 8:45 am.
