Client, mother of three, seeks assistance with a landlord/tenant matter. The eviction complaint seeks rent for August 2018 through October 2018, plus late fees, water, attorney’s fees, and court costs. The property has severe habitability issues that have been unresolved since inception of tenancy in February 2017, and Client has documented extensive correspondence with Landlord about said issues. The habitability issues include a roof leak, leaking basement walls, an uneven floor that caused Client’s 4 year old daughter to injure herself and go the hospital, a mice infestation, and a nonfunctioning washing machine. Landlord told her in writing to withhold all payments until repairs were completed. Defenses include breach of implied warranty of habitability, open L&I violations, failure to provide tenant with a Lead Safe Certificate, and excess security deposit. Client’s goal is more time in the property in order to move, and to avoid a money judgement. Opposing counsel is Kenneth L. Baritz, Esq. The hearing is on October 17, 2018 at 8:45 am in Room 3.
