19-0043946 Urgent Need
Client seeks assistance with an urgent landlord tenant matter. The eviction complaint seeks unpaid rent for June (partial) and July 2019, as well as late fees, attorney fees, water/sewer bill payment, and ongoing rent from the date of filing. Client has been living in the property with her four children for two years. Client has five-year-old twins that are listed on the lease but there is no lead safe certificate for the property. Client fell behind on rent after separating from her husband. Client also stopped paying the water bill last year because she was being charged the bill for the entire property and being led to believe it was just her portion. There has been a cockroach and rodent infestation since last summer which has caused the client and child to have allergic reactions. Client has medical bills for the treatments of their reactions. Defense includes a breach of implied warranty of habitability and failure to provide client with lead safe certificate. Client would like additional time in property to find new housing. Landlord is represented by Corey Baritz, Esq. Eviction hearing is scheduled for August 20, 2019 at 12:45 pm in Courtroom 3.
