Client seeks assistance with an urgent landlord tenant matter. The eviction complaint seeks rent for July (partial) and August 2019, attorney fees, court costs, and ongoing rent from the date of filing. Client has been living in the property for five years with her four children; one child is under six years old. Client has proof of rent payments for all months and a statement from the property manager that she never missed a rent payment. Property has multiple habitability issues such as water damage and rodent infestations. Client submitted written requests to have issues fixed, and when management failed to respond to her requests, she contacted L&I. Client’s youngest child has elevated lead levels. Landlord never provided client with a lead safe certificate, although documentation is unclear about if the house was built before or after 1978. Possible defenses include a breach of implied warranty of habitability, retaliation, and failure to provide a lead safe certificate. Client would like to additional time in the property to find new housing. Landlord is represented by Emanuel Kosacci, Esq.
