Client seeks assistance with an urgent landlord tenant matter. The eviction complaint seeks August rent, late fees, court costs, and ongoing rent from the date of filing. Client has been living in the property for over one year with her seven-year-old son. Client states the property has habitability issues of infestations and cracks in the wall. Client verbally asked landlord to make repairs to the property on multiple occasions. Client then told landlord she would begin withholding rent in August 2019 until the repairs were made. Landlord refused so client called L&I who issued seven violations. Defenses include open housing code violations and breach of implied warranty of habitability. Client wants landlord to make repairs to property so she can stay in the property. Landlord is represented by Michael Williams, Esq. Eviction hearing is scheduled for September 16, 2019 at 8:45am in Courtroom 3.
