Client seeks assistance with an urgent landlord tenant matter. The eviction complaint seeks (partial) May, June, July, and August 2019 rent, water bill, late fees, attorney’s fee, court costs and ongoing rent from the date of filing. Client has been living in the property since March 2019 with her partner and two daughters. Youngest daughter is two months old but client never received a lead safe certificate. Client stopped making payments towards rent after management refused to address mold issue throughout the property for months. Defense includes breach of the implied warranty of habitability and partial defense due to failure to provide lead safe certificate. Client wants landlord to resolve the mold issues so she can remain in the property. Landlord is represented by Howard Ford, Esq.
