Client seeks representation at an eviction hearing scheduled for February 20, 2020, at 12:45 pm in Municipal Court – Room 3. Client moved into the property in October 2018 and moved out of the property in late December 2019, returning the keys in January 2020. The eviction complaint seeks (partial) September 2019 rent, full rent from October 2019 through January 2020, late fees, attorney’s fee, court costs, and ongoing rent from the date of filing. Client has receipts that she paid for partial September and full October and November rent. Client withheld rent due to habitability issues and to save money to move into another property. Client never received a Certificate of Rental Suitability. Other defenses include breach of the implied warranty of habitability and excess security deposit. Client wants to avoid a money judgment.
