Client seeks assistance at an eviction hearing, to be rescheduled, in Municipal Court – Room 3. Client moved into the property in June 2019 with her husband and three children. She began withholding rent in November 2019 due to habitability issues, and the property has five current open L&I violations. Since she began withholding rent, landlord has threatened to lock them out and has generally harassed them. The eviction complaint seeks (partial) October 2019 rent, full November 2019 through February 2020, late fees, attorney’s fees, court costs, and ongoing rent from the date of filing. Defenses may include breach of the implied warranty of habitability, failure to receive the Certificate of Rental Suitability, and retaliation.
