Client seeks assistance at an eviction hearing, to be rescheduled, in Municipal Court – Room 3. Client moved into the property in 2016 with his daughter, who was five years old at the time. Client signed a lease with rent listed as $595/month, but made a verbal agreement with the landlord that is was $500/month due to extensive repairs needed in the property, including mold and a leaking roof. There are 7 L&I violations open on the property. Landlord would come to the property to pick up rent and give client the receipt. The eviction complaint seeks (partial) May 2019, full June 2019 through February 2020 rent, late fees, attorney’s fee, court costs and ongoing rent from the date of filing. Defenses include receipts for all rent being claimed and breach of the implied warranty of habitability. Client’s goal is to have additional time in the property before moving out, as well as his security deposit back. Landlord is Steve Ostroff, Esq and he is representing himself.
