Case #20-0044992

A victim of domestic abuse, seeks representation for a custody hearing initailly scheduled for June 4, 2020, at 9:00 AM before Judge Elizabeth Jackson, concerning her 8-year-old daughter. This matter will be rescheduled due to recent court closures. The current custody order gives the child’s maternal grandmother primary physical custody and her paternal grandmother has partial physical custody from Friday until Monday or at other times as the parties agree. Both grandmothers share legal custody. The grandmothers were awarded custody because client and the father were minors when the child was born. Although the parents do not have custody, the grandmothers had agreed to allow them to share in the care of their daughter. Father, however, exerted control over the situation and he began to withhold the child from maternal grandmother and client. Several times, when the maternal grandmother picked up the child from school, the father visited maternal grandmother’s house, destroyed items in her house, and physically took the child away. In other instances, when the maternal grandmother went to pick up the child, father and paternal grandmother would ignore her and not answer the door. Currently, nobody is following a consistent custody schedule. Client has only seen her daughter six times in the last six months. The child’s father has physically abused client in front of the child in the past, and client has a Protection from Abuse Order against him. On August 28, 2019, client filed a petition to modify custody, requesting sole physical and legal custody. Client wishes to change the custody arrangement because she is no longer a minor and would like to take care of her daughter. Client understands that representation may be limited to the upcoming court dates, and she is willing to sign a pro se entry of appearance when the agreed upon representation is complete
