Client seeks representation for a custody hearing that will be rescheduled when courts open, concerning his 7-year-old autistic child. The current custody order from December 2019, gives the child’s mother primary physical custody, and it gives the client partial physical custody on Saturdays from 10 am to 6 pm and every other Sunday from 10 am to 6 pm. The parties share legal custody. Mother, however, has withheld child for over six months. Client was ordered to attend Assessment & Treatment Alternatives (ATA) to have an evaluation completed regarding his enumerated offenses, but he has been unable to comply due to the current public health crisis. Mother has a temporary PFA against client. Client denies all allegations in mother’s PFA petition. Mother is also ordered to communicate with client through paternal grandmother about any special care classes for autistic children so client can attend, but mother has never complied with this order. In September 2019, father filed a petition to modify custody of child. In October 2019, mother filed a petition to modify requesting primary physical and sole legal custody. Father’s petition was consolidated with mother’s petition for the upcoming hearing. Client’s main goal is to have shared physical and legal custody in order to consistently see his son. A volunteer is needed to represent client at his upcoming hearing. Client understands that representation may be limited to the upcoming court dates, and he is willing to sign a pro se entry of appearance when the agreed upon representation is complete.
