Client seeks assistance at an eviction hearing, to be rescheduled, in Municipal Court – Room 3. Client moved into the property in March 2018 on a year-to-year lease. Landlord would not allow client’s fiancé to move into the property in December 2019 but told client that he could get out of his lease early. Client then worked with the property manager to schedule his move out, paid December rent in full, and moved out the second week of January having paid his last month’s rent in advance. Landlord did not return security deposit after client moved out, citing that client left belongings in the property. Client tried to remove a couch a week after moving out, but the locks had been changed. Client never received the water bill listed on the complaint. Client would like his security deposit returned and to have the complaint withdrawn. The eviction complaint seeks December 2019 through February 2020 rent, late fees, water bill, attorney’s fees, court costs, and ongoing rent from the date of filing. Landlord is represented by Kenneth Baritz, Esq.
