Client seeks assistance at an eviction hearing scheduled for Thursday, April 9, 2020, at 12:45 pm in Municipal Court – Room 3. Client moved into the property in June 2019 with her spouse and their adult son. Client and her spouse requested repairs be made to the property after they moved in but landlord failed to make repairs. Habitability issues include mold in the kitchen and bathroom. Client began withholding rent in February 2020 after the mold began affecting their spouse’s health and they needed medical attention. Defenses include breach of the implied warranty of habitability and failure to provide Certificate of Rental Suitability for months listed on the complaint. Client would like additional time to find new housing. The eviction complaint seeks January through March 2020 rent, late fees, court costs and ongoing rent from the date of filing. Landlord is unrepresented.
