Client seeks representation at an eviction hearing, scheduled for September 9, 2020, at 8:45 am, in Municipal Court – Room 3. The client moved into the property in August 2019 and recently moved out of the property when her lease ended in July 2020. In January the client’s electricity stopped because the property was illegally hooked up and the client began withholding rent in February. The client states she paid February’s rent and knows she is behind on rent, but not as much as listed on the complaint. Habitability issues include a leaking roof and broken sewer pipe in the basement. The client may have a potential counterclaim for the expenses she paid when the electrician came to fix her electricity. Defenses include breach of the implied warranty of habitability and evidence of paying February’s rent. The eviction complaint seeks February 2020 rent, late fees, court costs, and ongoing rent from the date of filing.
