Client seeks representation at an eviction hearing, scheduled for December 1, 2020, at 9:30 am, in Municipal Court. VIP can provide guidance on requesting a remote hearing (via Zoom), which is generally granted, or can provide details on the court’s significant COVID-19 precautions in the courtroom should the volunteer prefer to attend in-person. Client moved into the property in August 2018 with her son and daughter. In May 2020 client lost her employment due to COVID and filed for unemployment. She has attempted to receive rental assistance, but states her landlord would not sign off on it. In July 2020 client’s unemployment stopped and she was unable to pay August 2020 rent. Defenses include potential illegal lock out and no certificate of rental suitability. The eviction complaint seeks April 2020 – September 2020 rent, late fees, court costs, and ongoing rent from the date of filing. Client’s goal is to end her lease with the landlord and move out of the property. Landlord is unrepresented.
