Client seeks representation at an eviction hearing, scheduled for April 22, 2021, at 9:30 am, in Municipal Court. VIP can provide guidance on appearing in court remotely. Client moved into the property with her family in March 2016. Client was unemployed from March – June 2020 due to the current pandemic but states she continued to pay her rent on time. In October 2020 client noticed the only toilet in the property was leaking into the basement. She notified her landlord of the repair. The landlord had someone come out to inspect the repair, but it was not fixed. Client began withholding rent in November 2020 because of the toilet leak. Client has the rent money in savings. The eviction complaint seeks possession of the property and ongoing rent from January 2021. Landlord is suing client for termination of term and breaches of the lease including unauthorized occupant, tampering with water meter, chronically late payments, and more. Defenses include no lead-safe certificate, breach of the implied warranty of habitability, and expired rental license as of March 2021.
