A domestic violence survivor faces a semi-protracted custody hearing September 1, 2021 before Judge Tiffany Palmer at 1:30 pm. Client’s daughter is nine years old and the client has sole legal and primary physical custody. The child’s father, who is represented has partial custody alternating weekends, but he has been living in California since the fall of 2018. Client filed a petition to modify custody because father was not spending his weekends with her. The father now wants daughter to spend substantial time with him in California. Client feels reunification should happen slowly. The client suffered serious physical abuse from the father, and the child has seen him act violently toward others, but he has not been abusive toward the child. In April 2021 modification was before Judge Palmer who determined that a more complete hearing was necessary and relisted the matter for the semi-protracted hearing Sept. 1. Shortly after the April hearing, father filed a notice of intent to relocate and mother filed her objection to relocation. A volunteer is needed to represent client on Sept. 1, and the client understands that representation may be limited to this court date. Client has agreed to sign a pro se entry of appearance when the agreed upon representation is complete.
