Client and landlord agreed that client could make the repairs instead of paying rent. In February 2021, client received a notice to vacate for nonpayment of rent. Client stopped making repairs and has rent money in escrow. Current repairs include a broken kitchen sink and water damage in the dining room ceiling. The eviction complaint seeks possession of the property. Landlord is suing client for termination of term. Defenses include no lead-safe certificate, breach of the implied warranty of habitability and no good cause reason provided for termination of term. Landlord is unrepresented.
