Client seeks representation for a custody hearing scheduled December 1, 2021 before Judge Elizabeth Jackson at 9:00 am concerning her three daughters. There are three opposing parties. The children’s maternal grandmother, the youngest child’s father and the youngest child’s paternal aunt. Client became a mother at a young age and was homeless. The maternal grandmother obtained sole legal and sole physical custody of client’s two oldest children. In the case of the client’s youngest child, the grandmother has primary physical custody. The client, grandmother and paternal aunt share legal custody of the youngest child. The client, father and aunt have partial custody at the discretion of grandmother. However, the aunt and father have made no efforts to see the youngest child. In April 2021, client and grandmother made a verbal agreement that children would be under client’s care, but grandmother called the police on client for kidnapping after the verbal agreement. The client is withholding the children because she does not believe the children are safe at their grandmothers’ home. The client’s oldest daughters say that they have been sexually abused under their grandmothers’ care, and grandmother has a history of substance abuse. The father has a history of substance abuse, sexual assault, and domestic violence. From 2013 to 2018, the father was physically, verbally and sexually abusive towards the client. In 2018, the father was in jail for domestic violence against the client. There is an existing Protection from Abuse order issued against the youngest child’s father. Client’s goal is to have sole legal and sole physical custody of her three daughters. A volunteer is needed to represent client at her upcoming hearing on December 1, 2021.
