Client seeks representation at an eviction hearing scheduled for September 20, 2021 at 12:45pm in Municipal Court. Client moved into the property in August 2020. Client lost income due to the pandemic, but applied for rental assistance in August 2021. Due to recent flooding, client was evacuated for 4 days and incurred expenses. Landlord is suing for June and July 2021 rent, late fees, unpaid utilities, trash, insurance fees, garage fees, pest fees, service fees, attorney’s fees, court costs, and ongoing rent from date of filing. Parties are enrolled in the Eviction Diversion Program (EDP), but opposing counsel now refuses to engage in mediation. Defenses include landlord’s lack of good faith in EDP participation, rent and garage fee abatement due to incurred expenses and evacuation, and possibly landlord’s failure to wait 45 days after completing rental assistance application before filing eviction complaint. There is also a possibility for rent and garage fee abatement due to incurred expenses and garage evacuation Client’s goal is move out at the end of November.
