Client seeks representation at an eviction hearing scheduled for September 27, 2021 at 11:00 am in Municipal Court. Client began living in the property in December 2019 with her two young children. Client lost income due to the pandemic in March 2020. Client reports that landlord renewed her lease term to month-to-month over the phone in January 2021. Landlord is suing for March-June 2021 rent, late fees, attorney’s fees, court costs, and ongoing rent from date of filing. Client’s rental assistance application has been marked complete. Defenses include no lead certificate, receipts for rent paid in March 2021 and August 2021, lack of good cause reason for termination of lease and improper notice, and breach of the implied warranty of habitability due to multiple pest infestations and no hot water at the bathroom sink.
