Client seeks representation at an eviction hearing scheduled for December 21, 2021 at 1:30 PM in Municipal Court. Client started living in the property in October 2018. She lost income due to the pandemic. Client applied for rental assistance. There are multiple habitability issues in the property including electrical issues, pest issues, and more. Landlord is suing for September and October 2021 rent, late fees, unpaid water bill, eviction fee, court costs, and ongoing rent from date of filing. Landlord is also suing for termination of term and breach of lease due to late payment of utility bills. Defenses include water bill payment made, no Certificate of Rental Suitability provided to client, no EHPA notice, breach of the implied warranty of habitability. Client’s goal is to avoid a money judgment and remain in the property. Landlord is unrepresented.
