Client seeks representation at an eviction hearing scheduled for February 3, 2022 at 8:45am in Municipal Court. Client began living in property in May 2018. Landlord is suing for termination of term. Client has been approved for rental assistance. There are habitability issues in the home including open L&I violations for electrical hazards, interior stairs, and more. Defenses include open L&I violations, breach of Implied Warranty of Habitability, no lead certificate, no Emergency Housing Protection Act Notice, and possibly invalid good-cause reason to terminate month-to-month lease.
