Client seeks representation at an eviction hearing scheduled for May 18, 2022 at 8:45am in Municipal Court. Client moved into the property with her 3 young children in March 2021. Landlord is suing for Dec. 2021-April 2022 rent, late fees, attorney fees, court costs, and ongoing rent from date of filing. Client reports the property has a rodent infestation. Defenses include payments made towards rent, no notice of diversion rights provided to client, breach of the implied warranty of habitability, and possible lack of lead certificate. Client’s goal is to remain in the property and work out a repayment arrangement. Landlord is represented by Jenel Marraccini, Esq.
