Client seeks representation at an eviction hearing scheduled for May 24, 2022 at 12:45pm in Municipal Court. Client moved into the property with her young children in February 2020. Landlord is suing for Nov.-Dec. 2020, Apr.-July 2021, and Mar.-Apr. 2022 rent, unpaid water bill, court costs, and ongoing rent from date of filing. Landlord also suing for breach of lease by failure to allow landlord to make repairs, unauthorized occupants, and creating a fire hazard by blocking the entrance. Client denies breach of lease and states there is nothing blocking the entrance. Client is withholding April 2022 and ongoing rent due to landlord’s failure to make repairs. Client has applied for utility assistance and was approved for rental assistance. Defenses include payments made toward balance, no Notice of Diversion Rights provided to client, and breach of the implied warranty of habitability. Client’s goal is to move out of the property but she would need a minimum of 6 months before doing so. Landlord is unrepresented.
