Client seeks representation at a custody hearing on September 26, 2022, at 1:15 pm before Hearing Officer James Welkie, regarding her 8-year-old son with autism. Opposing party is the mother of client’s former partner. Client was living with opposing party when she gave birth to her son, and because she was struggling with homelessness, client and opposing party made an agreement that opposing party would take care of client’s son until client had stable housing. A January 2017 final custody order awarded shared legal and primary physical custody to opposing party, and partial physical custody to client. The Order is silent as to father because he was incarcerated at the time. Client filed for modification in May 2022. Client is now in stable housing and alleges that the opposing party is not obeying the order by withholding the child. Client has only had one visit with the child in the last five years. Client also alleges that the child is not safe because opposing party has a history of drug use. Client’s goal is to obtain sole legal and sole physical custody. A volunteer is needed to represent client at the upcoming hearing.
