Client seeks representation at an eviction hearing scheduled for August 11, 2022, at 8:45 AM in Municipal Court. Client moved into the property in 2008 with her infant; client had a second child under the age of six in the home until client and her family moved out in March 2022. Landlord is client’s sister. Landlord is suing for unpaid gas bill, unpaid water bill, move out fee, and court costs. Client advised that the gas company is charging a large fee for an illegal gas hookup which client advised she did not do. Client also advised that client paid her portion of the gas bill every month with her rent. Defenses include no lease to show proof of move-out fee or confirm utility responsibilities, no water bills on docket, and no Notice of Diversion Rights. Client has a potential claim against landlord for lack of lead certificate. Landlord is unrepresented.
