Client seeks representation at an eviction hearing scheduled for August 15, 2022, at 12:45 PM in Municipal Court. Client started living in the property in February 2021. Client took a leave of absence from work after the loss of a loved one and fell behind on rent. Landlord is suing for April-July 2022 rents, late fees, attorney’s fees, court costs, and ongoing rent from date of filing. Client paid April, May, and June rent for which she has receipts, and intends to pay July and August rent for the hearing. Defenses include receipts for payments, no lead certificate, client did not receive the notice to vacate, landlord failed to deliver Certificate of Rental Suitability or handbook to client, and client did not receive Notice of Diversion Rights. Client’s goal is to avoid a money judgment and remain in the property. Landlord is represented by Ken Baritz, Esq.
