Client seeks representation at an eviction hearing scheduled for August 15, 2022, at 12:45pm in Municipal Court. Client moved into the property in June 2021 on a month-to-month lease. The ceiling leaks; landlord claims to have repaired, but the ceiling continues to leak. Landlord is suing for Jan., May-Jun. 2022 rent, court costs, ongoing rent from date of filing, and termination of term. Client reports she paid rent for January and partial rent for May. The Certificate of Rental Suitability (CRS) expired in April 2021. Defenses include receipts for payments made, invalid CRS, breach of the implied warranty of habitability, no 30 days’ notice to vacate or written notice of a good cause reason to terminate the short-term lease, and possible lack of lead certificate. Client would like to remain in the property and set up a payment plan for any amount actually owed. Landlord is unrepresented.
