Client seeks representation at her eviction hearing on December 27, 2022 at 8:45 AM in Municipal Court. Client’s landlord is suing for June-September 2022 rent, ongoing rent from date of filing, and attorney fees. Client moved in 3 years ago, and renewed her lease in October 2021, with a lease end date of September 30, 2022. Client lost her job in July 2022. She began withholding rent because maintenance people repeatedly entered her apartment without providing notice, and in a way that made her feel unsafe. She states that the property manager has created an uncomfortable environment and purposefully harasses tenants of color like Client. The apartment has habitability issues including a huge crack in the wall that has not been fixed, and a mice infestation. Client’s goal is to move out. She does not want to pay back rent or have her credit impacted by a judgment. Possible defenses include: landlord’s failure to provide lead certificate, Certificate of Rental Suitability invalid due to issuance in June 2022, implied breach of habitability.
