Single father is being sued for possession and $1,000. After Client’s Landlord wishes to repossess the premises for personal use. Client has never missed his rent payments, even when the property needed significant repairs. During mediation through the Eviction Diversion Program, client’s Landlord would not compromise on how long client had to move out of the property, so the parties did not reach an agreement. Possible defenses include lack of Lead Safety Certificate on the docket and unsigned Certificate of Rental Suitability. Over the past five years, client made significant repairs to the premises and was never compensated by his Landlord; therefore there are potential counterclaims that could be brought . Client’s goal is to be granted at least 60 to 90 days to move out of the premises and  dispute the money judgement.
