Client seeks assistance in a mortgage foreclosure matter. Client’s mother and father are the record owners of the property. Mother died in 2011 and father died in 2015, both intestate. After their deaths, client learned that his niece had used improperly obtained Power of Attorney documents to as his mother and father’s agent. Niece took out a reverse mortgage on the property and subsequently defaulted. The lender has filed a foreclosure action on mother’s estate. Client needs a volunteer attorney to continue negotiations with lender at client’s next conciliation conference on November 8, 2018, at 9:00 am, and any subsequent conferences. VIP will look for another volunteer to help transfer title to client from parent’s estate if it seems the mortgage can be satisfied, as client would like to remain in the property even if he has to enter a payment plan to pay off the reverse mortgage.

Client seeks help probating the estate of her recently deceased husband. Only her husband is on the most recent deed to the home in which she and her minor daughter currently reside. Client does not owe any back taxes and is up-to-date on the mortgage payments for the property. Client also wishes to name her husband’s niece as guardian of her daughter’s estate so her daughter may receive half of her father’s life insurance policy with Aetna. A volunteer is needed to help client gain title to the home in which she and her daughter live and to assist client appointing a guardian to her daughter’s estate. Client has been very responsive and is eager to have this matter resolved.

A domestic violence survivor seeks assistance modifying the current custody order for her two small children and resolving custody contempt allegations. Opposing party (OP)/father and client/mother have shared physical custody. Client/mother is awarded slightly more time than father. OP/father, who is represented, filed a contempt petition alleging that client refuses to communicate with him about their son’s schooling and failed to make the children available on multiple occasions. Client/mother has cross-filed for contempt citing several late or missed exchanges caused by OP/father. Both parties have also filed petitions to modify custody that have been consolidated with their contempt petitions. A hearing on these matters is scheduled before Judge Doris Pechkurrow on July 8, 2019 at 9 am. Client understands that the scope of representation may be limited to the scheduled court date, and she is willing to sign a pro se entry of appearance after the hearing on July 8th. A volunteer is needed to assist the client in modifying her custody order as well as representing her on the issue of contempt.

Client seeks assistance obtaining custody of her grandchildren. Client is the paternal grandmother of two children, ages 7 and 8. Upon both parents’ arrest in 2011, for assault and endangering the welfare of a child, client agreed with both mother and father that she would take the children to Florida to live with a paternal aunt. When the aunt could no longer care for them, client brought the children to live with her in Philadelphia. They have now been with her for the last two years. No custody order was ever established. Mother now asserts that client took the children without her permission. Mother, who is represented, filed for sole physical and legal custody in March 2018, and client cross-filed for sole legal and physical custody in April 2018. Father supports client’s request for custody of the children. A protracted hearing is scheduled October 23, 2019 at 9 am before Judge Christopher Malios. A volunteer is needed to represent the client in that hearing. The client understands that representation may be limited to the scheduled court event and has agreed to sign a pro se entry of appearance upon conclusion of the October 23 hearing.

Divorce With Equitable Distribution

A survivor of domestic abuse seeks assistance with a divorce. Client/wife and opposing party (OP)/ husband were married in China in 1992 and separated in June 2017. Client has a current PFA against OP, and she has suffered head injuries as a result of the violence OP inflicted on her. OP was charged with aggravated assault, but only convicted of “harassment–subject other person to physical contact.” OP filed for divorce in March 2019 and a legal services agency filed an answer and counterclaim on client’s behalf seeking equitable distribution and alimony in April 2019. Client is unable to work due to pain from her injuries. Possible marital assets include a laundromat, a small take out restaurant, and a row home. Client is Mandarin speaking. VIP will provide a volunteer interpreter upon request as well as a volunteer to conduct a business valuation. A volunteer attorney is needed to represent client throughout the divorce process.

Client, father of four, seeks title to his home, which is owned by his deceased mother. Client’s mother died testate in 2010. In her will, she leaves the property to all five of her children including client. She names another one of her children as executor and all four of her other children as successor executors, with client being the last named successor executor. All of the deceased record owner’s children want client to have their interests in the property and are willing to renounce their right to administer the estate to client. There is an estate recovery claim against the record owner’s estate for approximately $48,000. A volunteer is needed to assist client with administering his mother’s estate and obtaining title to the property. The volunteer is also needed to help client determine what can be done to manage the estate recovery claim and any other debts that exist, including possibly an open mortgage.
