Disabled client, who is very responsive, seeks assistance with a probate matter. Client is living in home owned by his aunt and his mother as tenants in common. Client’s aunt died intestate in March 2012, and Client’s mother died testate in October 2012. Client’s mother devised her portion of the property to client and his brother. Client started probating his mother’s estate in 2013 by obtaining Letters of Administration. Client’s brother agrees to give up his portion of the property to client. Client has also received letters of renunciation from aunt’s intestate heirs and would like to also probate her estate. There are some major liens on property, including a Department of Human Services (DHS) lien from the aunt’s medical assistance for $100K and an IRS tax lien from his mother for $9K. Client is currently applying for a lifetime deferment of the DHS lien. A volunteer is needed to probate aunt’s estate, help client transfer title of the property to himself, and also help client try to resolve or manage remaining liens on the property.

Client seeks assistance with a probate matter. Client is living in the home owned by her deceased mother. Client’s mother died testate and appointed her friend as executrix of her estate, devising the property to client and client’s sister. The estate was opened in 2007, but the executrix has not finished probating the estate. Title to the property is still in client’s mother’s name. Client has not had any contact with the executrix. She has called her but has not gotten a response. Client would like to substitute herself in as executrix of the estate, in part because client is going through Chapter 13 bankruptcy, with assistance of counsel, and needs to deal with inheritance taxes due on this property. A volunteer attorney is needed to assist client with filing a petition to show cause why she should be appointed as executrix and help to finish probating the estate.

Client seeks assistance with a probate matter. Client is living in a property owned by his deceased common law wife. Client’s wife died intestate in 2019, leaving her siblings as potential heirs. However, if afforded the status of a common law spouse; client would inherit his wife’s entire estate. If not, then deceased wife’s siblings would inherit the property. A volunteer is needed to file a petition for citation to establish that letters of administration should be issued to client as a common law spouse, and assist the client with probating the estate, and assist the client to transfer and obtaining title to the property.

Client seeks assistance obtaining a deed to her property. In 1989, client and her then-husband entered into an installment contract with the Department of Veterans Affairs (VA) to purchase the property. In 1991, the VA transferred its ownership of the property to Banker’s Trust Company as Trustee for the American Housing Trust IX. When client and her ex-husband divorced in 2003, the property settlement agreement awarded the property solely to client, but the ex-husband never transferred his interest in the property to her. Client continued paying on the installment contract. Shortly after client made her final payment in November 2014, Bank of America sent client a deed that transferred ownership to client and her now ex-husband. However, client misplaced that deed before she could record it. In March of 2019, Bank of America recorded a Satisfaction of Mortgage, stating that it now owned the mortgage debt that the VA incurred in 1991 and was marking it satisfied. However, the 1991 document was a deed, not a mortgage, and there is no documentation provided that substantiates Bank of America as a successor-in-interest to Banker’s Trust. As a result, client now needs assistance in getting a new deed from Bank of America, including proper documentation of Bank of America’s interest in the property. Client will also need help applying to the Tangled Title Fund to pay for transfer taxes. Once title is in client’s and her ex-husband’s names, VIP can find another volunteer to enforce the terms of the divorce and have full title put into client’s name.
