Client, who is disabled, seeks assistance with a debt collection matter. Client is being sued by Bank of America for $12,645.39, and was served with the complaint on August 10, 2019. The underlying debt is from a credit card that client opened ten years ago. He could not keep up with payments after he had to stop working due to an injury. Client is reluctant to enter into a payment plan because he is a senior on a fixed income. A volunteer is needed to assist client with responding to the complaint and represent client at his arbitration hearing on April 23, 2020 at 2:00 pm. Client seeks assistance with a probate matter. Client is living in a property owned by her deceased great aunt. Great aunt died in 1974, and client started living in the property in 1975. Great aunt left a will devising the property to client without naming an executor. An administrator C. T. A. was hired to administer the estate close in time to the date of great aunt’s death, but he did not complete his duties as administrator and is now deceased. A volunteer is needed to help client file a Petition for Citation to Show Cause Why Petitioner [Client] Should Not Be Appointed Administrator, to help client probate her great aunt’s estate, and to draft a deed transferring title to client’s name.

Client received a large settlement from a tort case when she was a minor that resulted in a court-established Special Needs Trust. A corporate trustee was assigned to administer the trust. Client’s mother is her advocate, but the trustee has blocked client’s mother from assisting client with regard to the trust. Client would like to name her mother her agent under financial and healthcare powers of attorney so, among other things, her mother can help her deal with the trustee of her Special Needs Trust.
