Client seeks assistance with an urgent landlord tenant matter. The eviction complaint seeks June 2018 through May 2019 rent, water bill, damages, pet fee, late fee, attorney’s fee, court costs and ongoing rent from the date of filing. Client lived in the property from April 2018 to May 2019 with his partner and two children. Youngest child is five years old but client never received a lead safe certificate. Client stopped making payments in January 2019 after landlord’s wife demanded $3,000 in late fees. Client had only been late for two months due to purchase of space heaters because there was no functioning heat in the property. Landlord did not obtain Certificate of Rental Suitability until May 2019. Defenses include breach of the implied warranty of habitability, lack of Certificate of Rental Suitability for months listed on complaint, proof of payments made during some months listed on complaint, and partial defense due to failure to provide lead safe certificate. Client wants landlord to resolve the mold issues so she can remain in the property. Landlord is unrepresented. Eviction hearing is scheduled for October 21, 2019 at 8:45am in Courtroom 3.

Client seeks assistance in a mortgage foreclosure matter. Client’s mother and father are the record owners of the property. Mother died in 2011 and father died in 2015, both intestate. After their deaths, client learned that his niece had used improperly obtained Power of Attorney documents to as his mother and father’s agent. Niece took out a reverse mortgage on the property and subsequently defaulted. The lender has filed a foreclosure action on mother’s estate. Client needs a volunteer attorney to continue negotiations with lender at client’s next conciliation conference on November 8, 2018, at 9:00 am, and any subsequent conferences. VIP will look for another volunteer to help transfer title to client from parent’s estate if it seems the mortgage can be satisfied, as client would like to remain in the property even if he has to enter a payment plan to pay off the reverse mortgage.

Great-grandparents had three children, including client’s grandmother. Client’s two great aunts died unmarried and with no children. Client’s grandmother died a widow survived by her three children including client’s mother. There are currently three heirs: client, client’s cousin, and client’s brother. Client’s cousin and brother have signed renunciations electing client personal representative of her great-grandmother’s estate. Client needs title in order to qualify for City-run repair programs that could resolve roof leaks in her property. A volunteer is needed to help client probate her great-grandmother’s estate and to draft a deed transferring title to client’s name.
