Pennsylvania’s custody statute requires that a judge consider a party’s history of drug and alcohol abuse in determining the best interests of a child. VIP custody volunteers regularly ask questions about this factor in a judge’s decision. What should attorneys do when their clients disclose drug use or drug history? What weight is the judge likely to give to a drug issue in a client’s past? What evidence is needed to show that the opposing party has a serious alcohol problem?
